United States v. Virginia
Virginia Military Institute was an all male military style education institute. In 1990, a woman attempting to apply to VMI, was no admitted due to her sex, ignoring her level of qualifications. The Justice Department accused VMI of violating the fourteenth amendment, and that their admission policy was unconstitutional. In the District Court they ruled in favor of Virginia Military Institute, claiming that if women were admitted VMI would not uphold the same level of education. The Justice Departments appeal was granted and they went into the Fourth Circuit Court. Where they revered the hearing, and stated that if VMI could create an equal parallel school for women it would satisfy the equal protection of the law. VMI did, but this institution lacked the same funding, professors, and rigor that VMI held to men. So the Justice Department appealed and went to the Supreme Court. The Supreme Court ruled that VMI's admissions policy was unconstitutional and that the Virginia Women's Institute of Leadership, did not meet equal qualifications to be acceptable. The Justice Department won and VMI would not become a co-ed military institute.
