In the case against Claus Von Bulow, his wife Sunny, was found dead. The cause of it believed to be insulin. Claus Von Bulow was marred to Sunny and lived with her and his stepchildren. Sunny was found in the bathroom where she had blood covering her mouth. Her body temperature was at 80 degrees and her heartbeat was at 35 bpm. When she was found, she was in a coma, her second after many months. There are many dangerous levels of insulin some of which could cause permanent damage. According to Claus, he was on vacation at the time of the incident. Sunny's children believed that their stepfather had the intention of killing their mother so that he can receive her inheritance. Since Sunny was dead, they believed that the money would go to him. There was a black bag that contained belongings that they thought would be from Claus. There were many medications in that black bag. When the lawyers of each side were interviewing their clients, Gershowitz who was Claus's lawyer, had asked for the step children's lawyer to pass over notes that are necessary for both sides to have but the lawyer had refused. He also had the students that were helping him review a few things for the case as well. When Gershowitz had received the information about the insulin, he decided to send a few test tubes to the forensics lab. The insulin was found hanging off the needle and as the results came back there was something very interesting about them. When they sent needles that contained insulin, there were results claiming that there was no presence of insulin withing the needle. They were all false positives. He also studied the way that the black bag was being handled. The way that they were handling it was against the fourth amendment right of Claus. The trial was awaited for another year so that it could turn out to be more fair of a trial. In the notes that were given to the court, there was no mention in the insulin from the notes. Something else that was surprising was that the notes were taken days after the coma. Not months. The step children seemed to want to get rid of Claus easily because they may have wanted to get the money that their mother had for themselves but in the end neither of them would get the money.
i agree with what you are saying about handling the black bag right and this has also happened in many cases where the evidence is not collected properly. Maybe the case would have been different if evidence was handled properly.
ReplyDeleteI think this case is very important to be looked back on because it shows what can happen when assumptions are made without properly handling evidence. To avoid this mistake from happening again it should be reviewed on because a common theme I saw in class was inconsistencies with evidence. In this case and many others, we can see how it majorly effects the outcomes and conclusions about these situations. It can lead to time wasted on a subject that will no longer be relevant in the future and that slows trials down. People waste more time and money than needed because of the way evidence is handled sometimes.
